1. Introduction
This Acceptable Use Policy sets out what you may and may not do when using BPanel.net ("BPanel", "we", "us" or "our"), including the BPanel platform, the admin area and every website built on it (together, the "Service"). It forms part of our Terms of Service (bpanel.net/terms) and should be read with our Privacy Policy (bpanel.net/privacy).
This policy applies to every customer and every person with access to a customer's account ("Admin Users"). Each customer is responsible for making sure its Admin Users follow it. By using the Service, you agree to this policy.
The Service is for running your organisation's website. It must not be used for anything else.
2. Zero tolerance towards abuse
We do not tolerate abuse of the Service. You must not use the Service, or allow it to be used, to create, publish, store, send or link to anything that:
- is illegal, or promotes, encourages or helps anyone to carry out illegal activity;
- infringes anyone's copyright, trade marks or other rights, including pirated software, music, video or other material;
- is defamatory, threatening, abusive, harassing, hateful or discriminatory, or incites violence or hatred;
- includes child sexual abuse material;
- is pornographic or sexually explicit;
- relates to gambling, betting or gaming for money;
- sells or promotes illegal drugs, weapons or other illegal goods or services, or gives instructions for making them;
- is fraudulent or misleading, including scams, pyramid schemes and phishing;
- impersonates any person or organisation, or falsely suggests a connection with or endorsement by them; or
- publishes personal information or images of anyone without a lawful basis or, where needed, their permission.
Security
You must not:
- attempt to access any account, system or data without permission, including other customers' websites or data;
- probe, scan or test the security of the Service, or bypass any security measure, limit or restriction;
- upload or spread viruses, malware or any harmful code; or
- attack, overload or disrupt the Service, its suppliers or any other network, including through denial-of-service attacks.
Sign-in details must be kept secure and must not be shared outside your organisation.
3. Storage and resources
The storage and resources provided with the Service are for your organisation's website only. You must not:
- use the Service as personal storage, a file-sharing or download service, or a place to keep backups or archives;
- host large media libraries or files that are not part of your website;
- resell, sublicense or provide the Service to anyone else; or
- use the Service in a way that uses an unreasonable amount of resources or affects other customers.
We may set and change storage and usage limits at any time. If your use exceeds them, we may restrict your account or ask you to reduce it.
4. Acceptable email usage
You must only send emails through the Service, including newsletters, to people who have agreed to receive them or who you are otherwise lawfully allowed to contact. You must not:
- send spam or unsolicited bulk email;
- send emails that are misleading, threatening or likely to cause distress; or
- hide or falsify who an email is from.
Every newsletter must allow people to unsubscribe, and you must respect their choice.
5. Forms and personal data
When your website collects personal data, for example through application forms or newsletter sign-ups, you are the controller of that data and must comply with data protection law. In particular, you must:
- collect only the information you genuinely need;
- not ask for special category data (such as health, ethnicity, religion or sexual orientation) or criminal offence data unless it is genuinely necessary and you have a lawful basis and condition for collecting it;
- use the data only for the purpose you collected it for;
- make sure your website's privacy notice accurately explains what you collect and why; and
- respond to people's requests about their data, and delete data you no longer need.
6. Reporting a problem
If you believe content on the Service is unlawful or breaches this policy, please email [email protected] with a link to the content and why you are concerned. We will review reports and act as we consider appropriate.
7. Suspension and termination
We decide, at our discretion, whether this policy has been breached. If it has, or we reasonably suspect it has, we may do any of the following, immediately and without notice:
- remove or disable access to any content or website;
- issue a warning;
- suspend or restrict your account, any Admin User or any website;
- end your account, without refund;
- recover from you any costs we incur as a result of the breach; and
- share information with the police or other authorities where the law requires us to.
We are not liable for any loss caused by action we take under this policy. Breaching this policy is a breach of our Terms of Service.
8. Changes to this policy
We may update this policy from time to time. We will tell account holders about significant changes by email or by a notice in the admin area. The version and date at the top show when it last changed.
